Give Promotion Rules

The following official rules (the “Rules”) govern the Sticker Mule Give Program promotion (the “Promotion”), which is offered as part of the Sticker Mule Give Program (“Give Program”). The organizer of the Promotion (the “Organizer”) is the individual or entity that initiates and sets up the Promotion by creating it through Sticker Mule's website at www.stickermule.com (the “Website”). The Promotion is administered by Sticker Mule, LLC, together with its affiliates (“Sticker Mule” or the “Administrator”). The Organizer is responsible for organizing the Promotion, and Sticker Mule, as the Administrator, is responsible for administering the Promotion in accordance with these Rules. These Rules form a binding agreement between the Administrator and each eligible participant who enters the Promotion. In the event of any conflict between these Rules and any other description or communication regarding the Promotion, these Rules will control.

  1. Promotion Period.


    Each Promotion will run for a period determined by the Organizer before launch (the “Promotion Period”). The Organizer may select either:

    • Timed Promotion. A Promotion that runs for a fixed period of 24, 48, 72, 96, or 120 hours; or

    • Everyone Wins Promotion. A Promotion in which the Organizer chooses a fixed number of prizes to be made available to eligible entrants, and which automatically ends upon the earlier of: (i) the stated prize quantity having been awarded, or (ii) any maximum time limit that Sticker Mule may specify for that Promotion (if any).

    The Promotion Period and the applicable ending criteria will be displayed on that Promotion's page on the Website. The Administrator is the official timekeeper of any Promotion.

  2. Eligibility.


    The Promotion is open to legal residents of one of the fifty United States or the District of Columbia, and are age 18 or older, or the age of majority in their state of residence, whichever is older, at the time of entry. Eligibility is contingent upon agreement to, compliance with, and fulfillment of all requirements of these Rules and to the Sticker Mule General Terms of Service. Employees or agents of the Administrator, other related legal entities if applicable, or their respective parents or affiliate companies or suppliers, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee or agent, are not eligible. Legal entities are not eligible to enter. Participation in the Promotion in any way, including submission of any entry or the partial completion of any act of entry or any other step taken to participate in the Promotion in any manner, constitutes full and unconditional agreement with all provisions of these Rules.

  3. How to Participate.


    NO PURCHASE NECESSARY. PURCHASES DO NOT INCREASE ODDS OF WINNING. During each Promotion Period, you may enter a Promotion in one of the following ways, as applicable to that Promotion:

    • Website Entry. Completing and submitting all required fields on the Promotion's page on the Website.

    • Social Media Promotion. For Promotions that allow Entrants to interact with a post on a third-party social media platform in order to enter (each, a “Social Media Promotion”), by following the instructions in the Promotion post on the applicable platform (for example, by replying to, liking, or reposting a Promotion post, and completing any other steps described in that post).

    • Email Entry. By emailing your entry to help@stickermule.com (each of the above, an “Entry”). If you email your Entry, the subject line must include “Give Promotion” and a URL link to the specific Promotion must be added to the email body. Any email Entries more than 250 words are null and void. Email entry is not available for Social Media Promotions and Everyone Wins Promotions.

    By submitting an Entry by any method, you become an “Entrant” and agree to these Rules. Once your Entry is received and processed, the Administrator will enter it in the Promotion. Limit: one (1) Entry per person, per Promotion, regardless of method of entry. The Administrator may, in its discretion, disqualify any Entrant who attempts to submit more than one Entry for the same Promotion.

  4. Conditions of Entry.


    By entering or participating in the Promotion, each Entrant agrees to be bound by these Rules and by the decisions of the Administrator and its authorized representatives, which are final and binding in all matters relating to the Promotion. Entries that are not legitimately submitted in accordance with these Rules are void. Only qualified Entries received by the Administrator during the Promotion Period are eligible to participate.


    Entrants may be required to provide the following information to be eligible to receive a Promotion prize: first, middle and last name; month, day and year of birth; email address; complete mailing address; and phone number (collectively or individually, “Personal Information”). All requested Personal Information must be provided to participate in the Promotion and to be eligible to win a prize. Entries that are unintelligible or contain incomplete, invalid, incorrect, non-current, or damaged information, or that contain printing, production, or typographical errors, will be disqualified. Entries that are late, lost, damaged, misdirected, or not delivered are not the responsibility of the Administrator and will be disqualified. The Administrator is not responsible if a potential winner does not receive a prize because erroneous, expired, canceled, or fake information was provided in connection with the Promotion. Proof of sending an Entry and/or proof of receipt does not constitute proof of actual receipt of the Entry by the Administrator for purposes of this Promotion.


    Participation must be by the Entrant. Participation by any other individual or entity, or originating from any other website, email address, or phone number, is invalid and will be disqualified. Any attempt by an Entrant to obtain more than the stated number of Entries by using multiple email addresses, phone numbers, identities, registrations, or logins; entries through a sweepstakes club or similar entity; or any other unauthorized method of entry will void all of that Entrant's Entries and result in disqualification from the Promotion. Submitting mass Entries or Entries generated by an automated program, script, macro, bot, or other similar device, program, or method is prohibited and will result in disqualification.


    The Administrator may, in its sole discretion, disqualify any individual it finds to be in violation of these Rules, tampering with the entry process or the operation of the Promotion (including, without limitation, tampering with websites, email addresses, or phone numbers), or acting in an unsportsmanlike or disruptive manner. Any attempt to undermine the operation of the Promotion may be a violation of criminal or civil law, and the Administrator may seek damages and other remedies to the fullest extent permitted by law from any person it determines has made such an attempt.

  5. Prize.


    One (1) prize will be awarded to each winner. Each prize will consist of one (1) product selected by the Organizer for the Promotion for the following (each, a “Product”): t-shirt, die-cut sticker, sticker pack, rigid yard sign, and white label hot sauce (with the style, size, quantity, and design of the Product determined by the Organizer and/or the Administrator in their sole discretion). Approximate retail value of each prize is $25.


    Actual value of prize may vary. All additional costs, including, without limitation, surcharges, fees, taxes, and other personal charges not specifically described as part of the prize above are not included in the prize.


    No compensation or substitution will be provided for any difference in prize value. The Administrator is in no way responsible for any cancellations, delays, postponements, diversions, substitutions, changes in service, or any other act, omission, or result thereof, caused by any third party. A prize must be accepted as awarded without substitution and is not, in whole or in part, assignable, transferable, or available for resale. Prizes have no cash surrender value, except where required by law. The Administrator has made no warranty, representation, or guarantee, express or implied, in fact or in law, with respect to any prize. This includes, without limitation, any warranty, representation, or guarantee related to any prize's quality or fitness for a particular purpose. Prizes are subject to availability and the Administrator may substitute a prize (or a component thereof) with another prize of equal or greater value if the prize is not available for any reason, as determined in the Administrator's sole discretion. Other prize substitution options are available where required by law. Federal, state, and local taxes and all other costs and expenses associated with acceptance and use of any prize not specified herein as being awarded are the winner's sole responsibility. Prize specific terms and conditions apply. If the winner elects not to accept the prize, the prize will be forfeited. Any prize details not specified above will be determined by the Administrator in its sole discretion. If any potential winner is disqualified, not eligible, or for any other reason cannot accept the prize as stated, then the Administrator may select a new potential winner from the remaining pool of eligible Entrants. In the event that any mistake, failure, or discrepancy causes more than the stated number of prizes as set forth in these Rules to be promoted, noticed, or claimed, the Administrator may award only the stated number of prizes by conducting a random drawing from among all legitimate, unawarded, eligible prize claims. Each winner is responsible for any and all applicable fees, service charges, surcharges, all insurance, federal, state, and local taxes, and any other unspecified expenses associated with acceptance or use of the prize.

  6. Winner Determination and Verification.


    Winners for each Promotion will be determined based on the type of Promotion selected by the Organizer, as described below.

    • Timed Promotions. Within a reasonable time after the end of each Promotion Period, the Administrator will conduct a random drawing (each, a “Prize Drawing”) using an automated process determined by the Administrator. The Prize Drawing will select the number of potential winners specified for that Promotion in the entry interface, which will be at least five (5).

    • Everyone Wins Promotions. Potential winners will be determined during the Promotion Period as eligible Entries are received. Subject to eligibility verification, prizes will be awarded to the first eligible entrants up to the total number of prizes available for that Promotion, as specified in the entry interface.

    For all Promotions, each potential winner will be notified by email. The winners for each Promotion may be displayed on the Promotion page on the Website. Non-winning Entries will not carry over to any other Promotion.


    Verification. Each potential winner is subject to eligibility verification by the Administrator, whose decisions are final and binding in all matters related to the Promotion. An Entrant is not a winner of any prize, even if notified otherwise or provisionally issued any item of value, unless and until the Entrant's eligibility has been, and continues to be, verified to the Administrator's satisfaction.


    To be verified as eligible to receive a prize, a potential winner must meet all eligibility requirements, comply with these Rules, and provide any information or documentation requested by the Administrator. If a potential winner (i) cannot be contacted using the information provided, (ii) fails to respond to the Administrator's notification within a reasonable time, as determined by the Administrator, (iii) has any prize or notification returned as undeliverable (whether or not ultimately delivered), (iv) fails to provide required documentation, (v) is unable or unwilling to accept the prize as stated, or (vi) cannot be verified as eligible for any reason at any time before, during, or after the Promotion Period, that potential winner may be disqualified and will forfeit the prize, and an alternate potential winner may be selected from among the remaining eligible Entries.


    Once a winner is verified, the Administrator will ship the prize to the winner.


    Odds of Winning. For Timed Promotions, odds of winning any prize during any Promotion Period depend on the number of eligible Entries received for that Promotion Period and the number of prizes available for that Promotion. For Everyone Wins Promotions, the odds of winning any prize depend on the number of prizes available for that Promotion and the number and timing of eligible Entries received before the Promotion ends.

  7. Personal Information.


    By entering this Promotion, Entrant agrees to the Administrator's manner of collection, use, retention, and disclosure of Entrant's Personal Information submitted in connection with the Promotion. Personal Information collected from Entrant is subject to the Administrator's Privacy Policy, which is incorporated into these Rules by reference.

  8. Third-Party Services and Social Media Platforms.


    Use of Third-Party Services. This Promotion may be made available through, or require your use of, third-party websites, social media platforms, mobile apps, or other products or services (collectively, “Third-Party Services”). Third-Party Services are not operated by the Organizer or the Administrator. Third-Party Services are subject to their own terms of use and privacy policies, which you are responsible for reviewing. The Organizer and the Administrator do not endorse, monitor, or control any Third-Party Services or any content, policies, or activities made available through them (“Third-Party Content”). The Organizer and the Administrator are not responsible or liable for any Third-Party Services, any Third-Party Content, or any unavailability, errors, or failures of those services. Your use of Third-Party Services is at your own risk.


    Platform Changes and Failures. The Organizer and the Administrator do not guarantee that any particular Third-Party Service will be available or will function as expected in connection with any Promotion. If a Third-Party Service experiences an outage, restricts access, changes its features or APIs, removes or hides content, or otherwise interferes with the Promotion, the Organizer, or the Administrator may (but are not obligated to) modify, suspend, or cancel the Promotion or adjust winner selection in their discretion, and the Organizer and the Administrator will have no liability for any resulting loss or damage.


    Interactions on Third-Party Services. Your interactions with other users on Third-Party Services are solely between you and those users. To the extent permitted by law, the Organizer and the Administrator are not responsible for any interactions, disputes, or harm arising from or relating to those interactions, and have no obligation to intervene.


    Any Promotion covered by these Rules is in no way sponsored, endorsed, administered by, or associated with any Third-Party Service.

  9. Limitation of Liability.


    By entering or participating in the Promotion, or by accepting or using any prize in any way, each Entrant agree to indemnify, defend, and hold harmless, and does hereby release and discharge, the Administrator, its parent companies, subsidiaries, affiliates, vendors, advertising and promotional agencies, distributors, and each of their respective officers, directors, employees, and agents, as well as the immediate family members (spouse, parents, siblings, and children) and household members of each such individual (collectively, the “Released Parties”), from and against any loss, damage, injury, claim, or cause of action of any kind arising out of or related in any way to this Promotion, these Rules, or the rights, consents, and licenses granted to the Administrator under these Rules. This includes, without limitation, claims for infringement of any right of publicity or intellectual property; threatened or actual injury, loss, or damage to any person (including death or disability); defamation or portrayal in a false light (intentional or unintentional); invasion of privacy; and damage to or loss of property, arising out of the Entrant's participation in the Promotion or the receipt, use, non-use, or misuse of any prize. In no event will the Released Parties be responsible or liable for any damages or losses of any kind, including indirect, incidental, consequential, or punitive damages, arising out of or in connection with the Promotion.


    Entrant waives any right to claim ambiguity in these Rules. Without limiting the foregoing, the Released Parties are not responsible for: (i) technical failures of any kind; (ii) incorrect or inaccurate information, whether caused by Entrant, any internet or email service provider, any advertising or promotional agency, printing or computing errors, or by any equipment or programming associated with or used in the Promotion; (iii) unauthorized human intervention in any part of the entry process or the Promotion; (iv) technical or human error that may occur in the administration of the Promotion, the processing of Entries, or the announcement of any winner or prize; (v) any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, by an Entrant's participation in the Promotion; (vi) the receipt, use, or misuse of any prize; or (vii) any other errors in any materials, information, or announcements associated with the Promotion. If, for any reason, an Entrant's Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted by the Administrator, the Entrant's sole and exclusive remedy is to receive another Entry in the Promotion, if feasible and only if the Promotion Period has not expired.


    EACH ENTRANT EXPRESSLY WAIVES CALIFORNIA CIVIL CODE § 1542 (AND ALL SIMILAR LAWS OF ANY STATE OR TERRITORY OF THE UNITED STATES), WHICH PROVIDES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.” EACH ENTRANT REPRESENTS AND WARRANTS THAT THEY FULLY UNDERSTAND, ACKNOWLEDGE, AND ACCEPT THE SIGNIFICANCE AND CONSEQUENCES OF THIS WAIVER OF CALIFORNIA CIVIL CODE § 1542 (AND ALL SIMILAR LAWS OF ANY STATE OR TERRITORY OF THE UNITED STATES).

  10. License from Entrant.


    To the extent allowed by law, an Entrant's participation in the Promotion and/or acceptance or use of any prize constitutes that Entrant's consent to, and grant to the Administrator of, a non-exclusive, sublicensable, and assignable license to use, publish, post, and display the Entrant's name, likeness, photograph, voice, opinions, statements, prize information, Personal Information, and hometown and state, province, or territory, in the Administrator's sole discretion, for promotional, advertising, trade, and publicity purposes in any medium now known or later developed, worldwide and in perpetuity, without further notice, review, approval, payment, or consideration of any kind to the Entrant.


    This license applies regardless of whether such materials are altered, modified, edited, combined with other material, or used alone. All rights, consents, and licenses granted to the Administrator under these Rules will survive the termination or expiration of the Promotion. The mere ending of the Promotion or the Promotion Period does not revoke or limit any such rights, consents, or licenses.

  11. Disputes and Governing Law.


    Except where prohibited by law, Entrant agrees that: (i) all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded will be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state court located in Montgomery County, New York; and (ii) all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights or obligations of Entrant or the Administrator in connection with the Promotion, are governed by and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules, no matter what jurisdiction, that would cause the application of the laws of any jurisdiction other than as stated.

  12. General Provisions.


    Enforcement. The Administrator may investigate any reported, alleged or suspected violation of these Rules, and take any action that the Administrator, in its sole discretion, deems appropriate. Such action may include issuing warnings, suspension of a User's access to the Services, or complete termination of such access, at any time. The Administrator reserves the right to bring suit for any violation of these Rules.


    Electronic Communications. By participating in the Promotion, Entrant agrees to receive certain electronic communications from the Administrator, subject to applicable law. You also agree that your electronic agreement is the same as your signature on paper.


    No Waiver. The Administrator's failure or delay in exercising any right or enforcing any provision of these Rules will not constitute a waiver of that right or provision, and the Administrator may exercise or enforce any such right or provision at any time.


    Severability. If any provision of these Rules is held by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions of these Rules will remain in full force and effect.


    Entire Agreement. These Rules constitute the entire agreement between the Administrator and you with respect to your use of the Services, and supersede all prior and contemporaneous agreements, proposals, or understandings, whether written or oral, relating to your use of the Services.

  13. Notices.


    All notices pursuant to the Rules must be in writing and may be provided electronically. Notice must be made to Sticker Mule at:
