Events Terms of Service

PLEASE READ THESE EVENTS PROGRAM TERMS OF SERVICE CAREFULLY BEFORE PARTICIPATING IN STICKER MULE'S EVENTS PROGRAM. PARTICIPATION IN THIS PROGRAM CONSTITUTES YOUR ACCEPTANCE OF ALL THESE EVENTS TERMS.
Overview
These Sticker Mule Events Program Terms of Service (these "Events Terms") supplement and are incorporated into the Sticker Mule General Terms of Service (the "General Terms"). Capitalized terms used but not defined in these Events Terms have the meanings given to them in the General Terms.
The Events Program provides you the opportunity to use the Events tool on the Website (the "Events Tool") to organize one or more events (each, an "Event"). In these Events Terms, "Sticker Mule," "we," "us," and "our" have the same meanings as in the General Terms, and "you," "your," and "Organizer" refer to any User who organizes an Event. The Organizer is solely responsible for organizing, promoting, and hosting any Event.
The Events Program and Events Tool are part of the Services as described in the General Terms.
Binding Agreement
By participating in the Events Program, you are bound by these Events Terms and indicate your agreement to them. The Events Program is administered by Sticker Mule. All of Sticker Mule's decisions with respect to the Events Program are final and binding.
Our Events Terms May Change
We may update these Events Terms from time to time. If we make a material change, we will post a notice on the Website or otherwise notify you of the change. Please read any changes carefully. If you do not agree to the updated Events Terms, you must stop participating in the Events Program. If you continue to participate in the Events Program after we notify you of changes, you will be deemed to have accepted the updated Events Terms, except to the extent prohibited by applicable law. Some jurisdictions do not permit unilateral updates or changes to terms, so this paragraph may not apply to you.
Additional Terms
These Events Terms are subject to additional terms and conditions, including, without limitation, Sticker Mule's General Terms of Service, IP Rights Policy, Stores Terms, and Privacy Policy (collectively, the "Additional Terms"). The applicable Additional Terms are incorporated into these Events Terms by reference. If there is any conflict between these Events Terms and the applicable Additional Terms, the Events Terms will govern your participation and use of the Events Program. The applicable Additional Terms will otherwise continue to apply to your use of the Services or that specific product, service, program, or portion of the Services.
One set of Additional Terms is our Privacy Policy, which is incorporated herein by reference. Please refer to our Privacy Policy for information about how we collect, use, and disclose information about you. By using the Services, you agree to the terms of our Privacy Policy.
Eligibility and Account Requirements
To be eligible to use the Events Tool, you must:
- Create a user account on our Website (a "User Account").
- Be a legal resident of a participating country.
- Be 18 years of age or older (or the legal age of majority in your jurisdiction).
Use of the Events Tool
Create Event with Events Tool. The Events Tool provides a convenient way for you to organize, promote, and track your Events in one place. Using the Events Tool, the Organizer provides the Event title and details, uploads a personalized cover image, and selects the date, time, and location. The Organizer may add a link to a third-party service (for example, Zoom, Google Meet, YouTube, or Twitch) for people to join a virtual Event.
My Events Portal. You may track and manage your Events through your My Events portal on the Website, which lists your past and current Events.
Role of Sticker Mule. Sticker Mule acts solely as a platform provider for the Events Tool. We provide a technical means for you to create, publish, and manage Event pages and related links. We do not organize, host, sponsor, or supervise any Events. All Events are solely the responsibility of the Organizer. Sticker Mule has no obligation to monitor Events but may remove or disable access to any Event, in its sole discretion.
Disputes Between Organizers and Attendees. Your relationship with attendees and other participants in your Events is solely between you and those individuals. To the extent permitted by law, Sticker Mule will have no responsibility or liability for any disputes, claims, chargebacks, disagreements, or other issues between you and any attendee or other third party arising out of or relating to an Event, including those involving payments, refunds, cancellations, conduct at the Event, or the quality, safety, or fulfillment of the Event. Sticker Mule is not obligated to mediate or resolve any such matters, but may choose to do so in its sole discretion.
Event Changes, Cancellations & Communications. You are solely responsible for managing all changes to your Events, and for providing timely and accurate communications to attendees about any such changes, including any rights or remedies they may have (such as refunds or credits) under your policies or under applicable law. To the extent permitted by law, Sticker Mule is not responsible or liable for any loss, damage, or costs arising from Event changes or cancellations, or from your failure to notify attendees or provide refunds or other remedies.
Availability of Events Program. We will use commercially reasonable efforts to keep the Events Program active. However, there may be times when we must maintain, update, or improve the Website or temporarily suspend the Events Program. We do not guarantee that the Events Program will be available at any given time, and we will not be liable for any suspension, interruption, or discontinuance of the Events Program.
Processing and Sharing of Personal Information. Any personal data that you provide in connection with your use of the Events Program, including, without limitation, any data provided in connection with payment, will be processed in accordance with Sticker Mule's Privacy Policy.
License to Use Events Tool. Sticker Mule grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Events Tool in accordance with these Events Terms and the General Terms. Any violation of these Events Terms is grounds for immediate termination of this license and may result in legal action by Sticker Mule.
User Content. The Events Tool may permit the submission or transmission of certain user-generated content, text, photos, images, graphics, videos, comments, and/or other content, which are "User Content" under the General Terms. The User Content section of the General Terms applies in full to all User Content associated with your use of the Events Tool and your Events. Those General Terms provisions are incorporated into these Events Terms by reference. Sticker Mule is not obligated to monitor User Content related to your Events, but may remove any User Content in its sole discretion for any or no reason.
Organizer Responsibilities and Representations
As an Organizer, you are solely responsible for each Event you create using the Events Tool, including the Event's content, logistics, safety, and compliance with applicable laws. This includes:
- Complying with these Events Terms, the General Terms, and all relevant Additional Terms.
- Planning, organizing, and hosting the Event.
- Selecting and managing venues, vendors, staff, contractors, and security.
- Assessing and addressing risks to attendees and other participants (for example, crowd management, alcohol service, and physical safety).
- Complying with all applicable laws, regulations, venue rules, and industry standards that apply to your Event and venue.
By creating an Event, you represent and warrant that:
- All information you provide about the Event (including title, description, date, time, location, pricing, and any restrictions) is and will remain accurate, complete, and not misleading.
- Each Event is a bona fide event that you genuinely intend to organize, host, or otherwise facilitate.
- You have obtained and will maintain all rights, licenses, consents, permissions, approvals, and insurance necessary to organize and hold the Event at the selected location and to invite attendees there (including the consent of any property owner or venue operator).
- You will not use the Events Tool to organize or promote any Event for the purpose of harassing, threatening, intimidating, or otherwise targeting any individual or group, or to direct attendees to any location where they are not authorized or welcome.
- You are solely responsible for setting and enforcing any eligibility criteria and age restrictions for the Event, including where the Event involves alcohol, high-risk activities, or other regulated activities, and for ensuring that participation in the Event complies with all applicable laws, regulations, and venue rules.
- You will not use the Events Tool to organize or promote any Event that is illegal, unsafe, discriminatory, or otherwise violates these Events Terms or any applicable laws or regulations.
- Your use of the Events Tool will not infringe, misappropriate, or violate any third party's rights or these Events Terms.
Sticker Mule does not review or approve Events, and you acknowledge that you, and not Sticker Mule, are responsible for the planning, safety, and conduct of your Events.
Third-Party Services and Venues
The Third-Party Content and Interactions section of the General Terms applies in full to your use of the Events Tool and to all Events you create or manage using the Events Tool. The entire section is incorporated into these Events Terms by reference.
Third-Party Venues. Events may take place at, or use services provided by, third-party venues or providers (for example, event spaces, caterers, or transportation providers) ("Third-Party Venues"). Third-Party Venues are not operated or controlled by Sticker Mule and are subject to their own terms and policies, which you are responsible for reviewing and complying with. You are solely responsible for selecting, contracting with, and managing any Third-Party Venues for your Events, and for all fees and obligations arising from those relationships. Sticker Mule is not a party to your agreements with Third-Party Venues and is not responsible or liable for their acts, omissions, availability, safety, or compliance with law.
Interactions with Third Parties. Your interactions with attendees or other third parties on Third-Party Services or at Third-Party Venues are solely between you and those individuals. To the extent permitted by law, Sticker Mule is not responsible for any interactions, disputes, or harm arising from or relating to those interactions, and has no obligation to intervene.
Disclaimer; Assumption of Risk and Limitation of Liability
Your participation in the Events Program is subject to the Warranty Disclaimer, Indemnification & Release, and Limitation of Liability sections in the General Terms, which are incorporated into these Events Terms by reference.
Assumption of Risk by Attendees. For clarity, and as described in Organizer Responsibilities and Representations, you—not Sticker Mule—are responsible for your Events and for attendees' safety.
Events may involve risks, including the risk of illness, injury, property damage, or other loss. By using the Events Tool, you understand and agree that:
- Attendees and other participants choose to attend your Events at their own risk.
- As between you and Sticker Mule, you are responsible for explaining any material risks of your Events to attendees and other participants.
- You are responsible for obtaining any consents, waivers, releases, or acknowledgments from attendees that you believe are appropriate for your Events.
Sticker Mule is not responsible for informing attendees of risks associated with your Events and does not assume any duty to protect attendees or other participants.
No Sticker Mule Liability for Events. To the maximum extent permitted by law, Sticker Mule is not responsible or liable for your Events or for what happens at or on the way to or from an Event. Sticker Mule does not make any promises or guarantees about the quality, safety, legality, or suitability of any Event, venue, activity, organizer, vendor, or attendee. Sticker Mule will not be liable for any claims, losses, injuries, damages, costs, or expenses of any kind arising out of or relating to: (i) your planning, promotion, or operation of an Event; (ii) the conduct, actions, or omissions of you, your staff, vendors, contractors, attendees, or any other third party; or (iii) any decisions attendees or other participants make in reliance on information you provide about an Event.
