Ship terms of service

PLEASE READ THESE SHIP PROGRAM TERMS OF SERVICE CAREFULLY BEFORE PARTICIPATING IN STICKER MULE’S SHIP PROGRAM. PARTICIPATION IN THIS PROGRAM CONSTITUTES YOUR ACCEPTANCE OF ALL THESE SHIP TERMS.
Overview
These Ship Program Terms of Service (these “Ship Terms”) supplement and are incorporated into the Sticker Mule General Terms of Service (the “General Terms”). Capitalized terms used but not defined in these Ship Terms have the meanings given to them in the General Terms.
In these Ship Terms, “Sticker Mule,” “we,” “us,” and “our” have the same meanings as in the General Terms, and “you,” “your,” and “Shipper” refer to any User who participates in the Ship program (the “Ship Program”). The Ship Program provides you the opportunity to use the Ship tool on the Website (the “Ship Tool”) to access and use shipping-related functionality, including the ability to purchase third-party courier services and postage, manage your shipping history, and use other features we make available from time to time.
The Ship Program and the Ship Tool are part of the Services as described in the General Terms.
Binding agreement
By accessing or using the Ship Tool or otherwise participating in these Ship Program, you agree to be bound by these Ship Terms, which form a binding agreement between you and Sticker Mule. The Ship Program is administered by Sticker Mule, and all of Sticker Mule’s decisions relating to the Ship Program are final and binding.
Our Ship Terms May Change
We may update these Ship Terms from time to time. If we make a material change, we will post a notice on the Website or otherwise notify you of the change. Please read any changes carefully. If you do not agree to the updated Ship Terms, you must stop participating in the Ship Program. If you continue to participate in the Ship Program after we notify you of changes, you will be deemed to have accepted the updated Ship Terms, except to the extent prohibited by applicable law. Some jurisdictions do not permit unilateral updates or changes to terms, so this paragraph may not apply to you.
Additional Terms
These Ship Terms are subject to additional terms and conditions, including, without limitation, Sticker Mule’s General Terms of Service, IP Rights Policy, Stores Terms, and Privacy Policy (collectively, the “Additional Terms”). The applicable Additional Terms are incorporated into these Ship Terms by reference. If there is any conflict between these Ship Terms and the applicable Additional Terms, the Ship Terms will govern your participation and use of the Ship Program. The applicable Additional Terms will otherwise continue to apply to your use of the Services or that specific product, service, program, or portion of the Services.
One set of Additional Terms is our Privacy Policy, which is incorporated herein by reference. Please refer to our Privacy Policy for information about how we collect, use, and disclose information about you. By using the Services, you agree to the terms of our Privacy Policy.
Eligibility and Account Requirements
To be eligible to use the Ship Tool, you must:
- Create a user account on our Website (a “User Account”).
- Be a legal resident of a participating country.
- Be 18 years of age or older (or the legal age of majority in your jurisdiction).
Use of the Ship Tool
The Ship Tool
The Ship Tool provides a convenient way for you to generate shipping labels, compare available shipping options and rates, and complete purchases of shipping labels, and may save shipment-related information (such as addresses, payment information, and package details) to facilitate future transactions and allow you to view and track your shipments in one place.
My Shipments Portal
You may track and manage your shipments through the My Shipments Portal on the Website, which lists your past and current packages and provides links to Carrier tracking information on the applicable Carrier website. Access to and use of the My Shipments Portal, including any tracking information displayed or linked, is provided solely for your convenience and is subject to the terms and conditions of the applicable Carriers.
Role of Sticker Mule and Carriers
Sticker Mule acts solely as an intermediary between you and United Parcel Service (and any other participating carrier, if applicable) (each, a “Carrier”). We only provide you with a platform to order postage, labels, and related shipping products and services.
No Control Over Carriers; No Responsibility for Carrier Information
Sticker Mule has no control over any Carrier. Sticker Mule is not responsible for the accuracy, timeliness, completeness, or quality of any information, services, or actions of any Carrier.
Shipping Contract; Risk of Loss; Claims
Your shipments are made pursuant to a shipping contract between you and the applicable Carrier. Risk of loss and title to anything you ship pass to you as soon as your shipment is delivered to the Carrier. You are solely responsible for filing any claims with the Carrier for damaged, lost, or delayed shipments, subject to any Carrier or other legal or contractual requirements.
Carrier Terms and Conditions
It is your responsibility to locate, read, understand, and accept the applicable Carrier’s terms, conditions, and rules of purchase. You are responsible for ensuring that your purchases comply with all applicable Carrier terms and conditions.
Undeliverable or Returned Shipments
If a shipment is delivered to Sticker Mule by a Carrier for any reason—including because the Carrier determines the shipment is undeliverable as labeled and/or cannot be returned to the sender—Sticker Mule may, in its sole and absolute discretion and without notice to you or any other party, destroy the shipment or take any other action in accordance with applicable law. Sticker Mule will have no liability to you or any other party for any actions taken (or not taken) with respect to such shipments.
Availability of Ship Program
We will use commercially reasonable efforts to keep the Ship Program active. However, there may be times when we must maintain, update, or improve the Website or temporarily suspend the Ship Program. We do not guarantee that the Ship Program will be available at any particular time, and we will not be liable for any suspension, interruption, or discontinuance of the Ship Program.
Ship Program Payment Terms
Payment for Ship Program
Access to and use of the Ship Program is fee-based. You agree to pay Sticker Mule all fees and charges applicable to your use of the Ship Program (including, without limitation, per-label or per-shipment charges, postage and shipping services from Carriers, and any other fees disclosed at checkout) at the time such services are ordered by you using the Ship Tool. Fees for the Ship Program will be as listed at the time you purchase shipping labels or related services. You will be billed via our designated third-party payment processor using the payment method(s) you have provided.
Taxes and Other Charges
When you make a payment in connection with the Ship Program, you agree to pay the price listed for the Ship Program services you select, together with any additional amounts relating to applicable taxes, credit card fees, bank fees, foreign transaction fees, foreign exchange fees, currency fluctuations, and any other charges disclosed at checkout.
Payment Methods; Accuracy; Unpaid Amounts
You are responsible for ensuring that your banking, credit card, debit card, and/or other payment information is current, complete, and accurate at all times. If any amounts due for services through the Ship Program remain unpaid, or if any credit/debit card charge or online payment service is denied, returned, or refused, you agree to pay, in addition to the principal amount and any applicable interest, all bank and payment provider charges assessed against you and Sticker Mule, as well as Sticker Mule’s reasonable costs of collecting or attempting to collect such amounts, including reasonable attorneys’ fees and expenses. All transactions originating from your User Account are your responsibility.
Third-Party Payment Processors; Credit Authorization
You agree to comply with all applicable terms of service, privacy policies, and other legal agreements or restrictions (including any age restrictions) imposed by our third-party payment processor(s). We reserve the right to verify your credit at any time before you purchase services through the Ship Program. If any credit/debit card charge or online payment service is denied, returned, or refused, Sticker Mule may charge the underlying payment and any incidental charges described in this Section against any other form of payment you have ever added to your User Account.
Additional Charges; Adjustments
You are responsible for any additional charges assessed after shipment, including charges due to: (i) misstatements regarding weight, size, classification, number, or manner of service; (ii) deliveries on weekends or holidays; (iii) local customs charges; (iv) import taxes or duties; or (v) any similar charges incurred. If any such charges become due as a result of services performed by a Carrier on your behalf and are charged to Sticker Mule by a Carrier, you agree that Sticker Mule may charge your designated payment method or any other form of payment you have ever added to your User Account for the additional amounts due. If you paid for the services through the Ship Program in another manner, you agree to reimburse Sticker Mule fully for such charges within 7 days of our demand. Sticker Mule is not required to provide any automatic refunds or reductions in charges for any misstatement by you of weight, size, number, or manner of service.
Processing and Sharing of Personal Information
Any personal data that you provide in connection with your use of the Ship Program, including, without limitation, any data provided in connection with payment, will be processed in accordance with Sticker Mule’s Privacy Policy. We may share your payment information with payment service providers to process payments; prevent, detect, and investigate fraud or other prohibited activities; facilitate dispute resolution such as chargebacks or refunds; and for other purposes associated with the acceptance and processing of credit cards, debit cards, ACH, or other payment methods. If you make a payment for the Ship Program, we may receive information about your transaction, such as when it was made, when a subscription (if any) is set to expire or auto-renew, the platform on which you made the purchase, and other transaction-related information. Sticker Mule will not be responsible or liable for any errors made or delays caused by a payment processor, your bank, your credit card company, or any payment network.
Changes to Billing and Prices
Sticker Mule may change billing procedures, prices, and/or promotions at any time without advance notice. Your continued use of the Website or the Ship Program after any such changes constitutes your affirmation that you have read, understood, and agreed to the updated procedures, prices, and/or promotions.
All Transactions Final
All payments for the Ship Program (including, without limitation, per-label or per-shipment charges, and other fees) are final and not refundable or exchangeable, except as required by applicable law. We make no guarantee as to the nature, quality, or value of the Ship Program or the availability or supply thereof. Refunds or credits are not provided for any unused or partially used services offered under the Ship Program, except as required by applicable law.
Refunds; Unused or Misprinted Postage
Any claim for unused or misprinted postage or a refund fee must be submitted directly to Sticker Mule within 20 days of the date of purchase. Postage that has been handled and/or returned to sender will not be considered valid unused and/or misprinted postage and will not be eligible for a refund.
